Our firm has substantial experience in defending financial institutions, brokers, advisory firms, and other individuals in regulatory matters. We have defended national broker dealers in significant SEC enforcement matters in matters alleging conflicts of interest, fraud, suitability, Reg BI, and supervisory failures. We handled a one- year investigation involving significant allegations asserted against a New York based hedge fund and its principal, which arose from an internal investigation and well publicized allegations of fraud. We have handled to conclusion two SEC enforcement matters concerning allegations of Reg BI, and have represented a very prominent financial advisory firm which provided advice to professional athletes in a significant enforcement mater alleging fraud and misappropriation. A number of the matters we have handled were resolved with “no action” letters. In recent years, we have also been retained to conduct highly sensitive internal investigations, two of which conducted for national broker dealers. Both resulted in discussions with regulators, presentations to enforcement staff and ultimately no regulatory action being taken against our clients and no “Wells notice”. In addition to the above, we have handled and currently handle multiple investigations initiated by state regulatory authorities, including those initiated by CA, WA, OR, AZ, MA and VT. Despite our size, our clients regularly retain us for their most sensitive regulatory investigations including those that often are assigned to law firms much larger than ours.
