WELCOMING TT & E'S NEWEST PARTNER AND CELEBRATING THE OPENING OF OUR EAST COAST OFFICE

TT & E is excited to announce the opening of a Boston, Massachusetts office and to welcome our newest partner and colleague who will head up that office, Thomas Barnett. Tom is the former Vice President and Associate General Counsel at LPL Financial LLC. A longtime friend and in-house client of TT & E, Tom joins us as TT & E's broker-dealer practice continues to grow. Tom's background and bona fides in the industry deepen TT & E's experience as a highly skilled broker-dealer defense firm, now with locations on both coasts.

RECENT ACCOMPLISHMENTS IN PORTLAND

  • In Spring 2021, represented national broker-dealer in resolving over 40 arbitrations involving over 50 claimants. 
  • Worked with insurance carrier and 13 opposing counsel in "bet-the-company" situation.  Over several months of negotiations, preparation of financial analyses, and multi-day mediation, resolved nearly all matters, which enabled Firm’s clients to survive onslaught of litigation arising from sale of alternative investments.
  • Successfully resolved three-year SEC investigation and enforcement matter for broker-dealer concerning alleged failures to safeguard customer records and private financial data.  Investigation revealed data breaches implicating 4,900 customers and alleged violations of Reg SP, and Sections 206(4) of Adviser's Act. 
  • Represented prominent civil rights attorney in malpractice lawsuit filed by former client. After two motions for sanctions were granted and plaintiff was ordered to produce additional records or face terminating sanctions, matter settled for nuisance value. 

  • Represented prominent business manager in multimillion-dollar dispute involving prominent professional athlete.  Matter was resolved on favorable confidential terms and no lawsuit ever filed.
  • Represented prominent Pacific Northwest law firm against legal malpractice claims involving complex tax matters and opposing party seeking $6 million in damages.
  • Represented bankruptcy trustee facing claims brought by creditor in underlying bankruptcy case, alleging that it did not receive full value of debt due to alleged negligence of trustee. After successful early motion practice, claims were dismissed.
  • Secured summary judgment on all claims brought against nationally recognized clean energy company and obtained attorney's fees award against plaintiff.  

RECENT ACCOMPLISHMENTS IN LOS ANGELES


  • Won summary judgment in favor of insurance agents in seven-figure insurance coverage case that alleged professional negligence and fraud causes of action against insurance agents, resulting in dismissal of clients from lawsuit.
  • Prevailed on motion to dismiss in multi-party federal action alleging variety of federal and state-law based causes of action against home sellers, government entity, and various financial industry and investor defendants.
  • Negotiated settlement of TCPA class action for defendant that was less than one percent of amount initially demanded by plaintiffs.
  • Prevailed on demurrer and motion to dismiss in case against financial management firm alleging negligence, tortious interference, and unfair business practices.
  • Mediated multi-claim wrongful termination-employment discrimination case and resolved for favorable, confidential terms--less than 25% of damages sought by claimant--with no lawsuit ever filed.
  • Secured favorable settlement at mediation in multi-claim, constructive discharge-failure-to-accommodate case and resolved for favorable, confidential terms--less than 23% of damages sought by claimant--with no lawsuit ever filed. 
  • Resolved pre-litigation claim alleging professional negligence against insurance broker for nuisance value; no lawsuit ever filed. 

 

  • Prevailed on demurrer resulting in dismissal without leave to amend at pleading stages of Ralph Act (racial discrimination) cause of action in employment discrimination litigation.
  • Obtained dismissal of plaintiff without leave to amend at pleading stages; plaintiff had alleged third-party beneficiary status in real estate transaction and related fraud litigation. 
  • Obtained dismissal of petition to vacate arbitration award after filing and arguing brief demonstrating petitioner's petition was untimely.
  • Obtained dismissal after filing motion for summary judgment in seven-figure legal malpractice case involving underlying bankruptcy litigation.
  • Obtained dismissal of fraud action representing national sports retailer and its former management involving in case involving asset-backed lender foreclosing on company’s assets pursuant to Article 9 UCC sale with no money paid by client to secure dismissal.
  • Prevailed on early motion to dismiss in case against financial management firm alleging negligence and unauthorized practice of law.
  • Secured dismissal of fraud and breach of fiduciary duty action against wealth management company with no money paid by client.
