Washington Court of Appeals Affirms Dismissal in Favor of TTE Client

TTE recently a garnered win from the Washington Court of Appeals when it affirmed the dismissal of a Complaint on behalf of TTE’s client NFP Property and Casualty Services. In Jensen v. Rchain Cooperative et al., King County District Court Case No. 24-2-10012-1, plaintiff brought suit against over 20 defendants related to the failed blockchain company RChain. Plaintiff named NFP as a defendant asserting numerous claims including breach of contract, breach of fiduciary duty, and unjust enrichment. The claims against NFP were supported on the basis of one bare recital identifying NFP, but failing to include any specific allegations about its role or alleged wrongdoing. After attempts to confer were unsuccessful, TTE filed a motion to dismiss the complaint for failure to state a claim. In opposition, plaintiff filed a declaration attaching exhibits outside the four corners of the Complaint. At oral argument, the Court indicated that it would need to convert the motion to one for summary judgment. Counsel did not object to the conversion. Ultimately, the District Court granted the converted summary judgment motion, dismissing the complaint with prejudice. The Court of Appeals dispensed with the issues on appeal and affirmed the lower court. It found that the conversion to summary judgment was not in error. Nor was the grant of summary judgment: “argumentative assertions are not sufficient to create a genuine issue of material fact.” On brief were Amir Tadjedin (who also argued) and Julie Engbloom, with assistance from Vera Warren and David Wakukawa.
